R-99-13 RESOLUTION TO APPROVE THE REQUEST OF EUROPEAN BODY WORKS, INC., FOR A SPECIAL EXCEPTION TO CHAPTER 26 OF THE CITY CODE ON THE PREMISES KNOWN AS 3164 CAMPBELL DRIVE, AND MORE PARTICULARLY DESCRIBED AS TAX MAP PARCELS 48-3-((9))-030 AND 031. WHEREAS, European Body Works has submitted Application No. SE-240-99-1 requesting a Special Exception to the City Code listed below: Section 26-39.4-requires one parking space per 250 square feet of gross floor area; two parking spaces per repair bay; and, one parking space per employee. WHEREAS, City Council has carefully considered the application, the recommendation of the staff and testimony received at the public hearing; and WHEREAS, City Council has determined that the proposed Special Exception is appropriate because the proposal meets the requisites established by City of Fairfax Code Section 26-39.7 and Section 26-103(c) for the following reasons: 1. Consistent with the recommendations of the Comprehensive Plan, 2. Will not have an adverse impact on the surrounding area, 3. Will not result in increased traffic congestion or otherwise negatively impact existing traffic flow or pedestrian and vehicular safety, 4. Necessary to permit reasonable use of the subject property. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fairfax on this 13th day of April, that Application No. SE-240-99-1 be and hereby is APPROVED with the following conditions: 1. The number of employees working at this location shall not exceed eight at any one time. 2. The eight parking spaces located on-site shall be designated and used for employee parking only. 3. No employee parking shall be permitted on Campbell Drive. 4. No outside storage or parking of customer vehicles shall be permitted on this site or on Campbell Drive. 5. Trash collection shall be accommodated only within the building. All customer cars shall be driven to this repair facility from an off-site location identified and designated for drop-off and pick-up of customer vehicles. 7.
