R-99-38 RESOLUTION TO APPROVE THE REQUEST OF TED BRITT FORD SALES, INC., FOR A SPECIAL EXCEPTION TO CHAPTER 26 OF THE CITY CODE TO ALLOW REDUCTION OF THE PARKING REQUIREMENT ON THE PREMISES KNOWN AS 11091 MAIN STREET, AND MORE PARTICULARLY DESCRIBED AS TAX MAP PARCELS 57-1-((2))-31 AND PT. 3lA. WHEREAS, Ted Britt Ford Sales, Inc. has submitted Application No. SE-243-99-1 requesting a Special Exception to the City Code Section listed below: Section 26-39.4(b) - Off-street parking shall be provided in accordance with the following minimum standards: one parking space for every 500 square feet of gross floor area, or two spaces for every three employees, whichever is greater, plus one space for every 300 square feet of office and sales space, plus one space for each vehicle to be retained on the premises. WHEREAS, City Council has determined that the proposed Special Exception is appropriate. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fairfax on this 23rd day of November, 1999, that Application No. SE-243-99-1 be and hereby is APPROVED with the following conditions: 1. The applicant shall provide six employee or delivery parking spaces for each warehouse and such parking spaces shall be reserved and clearly signed for employee or delivery parking. 2. Customer viewing of inventory stored on the 1-2 portion of the subject site shall be subject to the following conditions: a. Customers who wish to view a vehicle stored on the Property will be chauffeured to and from the site by a Ted Britt employee; b. No customer visiting the site for the purpose of viewing a vehicle will be permitted to park on site; c. No vehicle sales transactions will occur on the Property; and d. No test drives will be initiated from the property; cars will be shuttled to the Ted Britt site for test driving purposes. 3. The property shall be brought into full compliance with the site plan requirements for the 1-2 District, with the exception of those instances where a waiver or modification has been approved in conjunction with the approval of the SE/SUP plat. 4. If a board-on-board fence is not provided to screen the Property Yard each vehicle stored on the property yard outside the structure shall be parked in a city-standard parking space. 5. The applicant shall ensure that no vehicles or parts are sold from the storage warehouses shown on the SE/SUP plan. 6. The applicant shall ensure that no vehicle repairs, reconditioning or detailing is performed on the subject site. 7. The applicant shall ensure that all parts stored on the subject site are for use only by the Ted Britt Ford and Smart Wheels dealerships, and for retail sale to the general public through the C-2 portion of the site. 8. Prior to issuance of an Occupancy Permit, the applicant shall provide a site plan for review and approval by the Zoning Administrator that notes all parking areas to be restriped to the required parking space dimensions. The site plan shall include a fire lane plan reviewed and approved by the Director of Building Code Administration. 9. The applicant shall ensure that only new vehicles are stored on the property yard area of the subject site (with the exception of the six employee/delivery parking spaces). 10. Should the applicant in the future release Building #2 on the site plan to a use that requires parking in this area, the number of new vehicles parked shall be reduced prior to issuance of any occupancy permit for R-99-38 -2 said use in Building #2 to accommodate the parking requirements for Building #2. 11. Ingress and egress to the property yard and storage structures by new car carriers will be limited to the Main Street entrance only. 12. Approval of the parking reduction for the auto and parts storage warehouse shall be valid for 12 years or until the use of the building changes, at which time the full parking requirement shall be provided. 13. The applicant shall ensure that the SE/SUP plan prepared by Bengtson, DeBell and Elkin, Ltd., dated April, 1999, and revised through October, 1999, is further revised to reflect the necessary changes generated by these conditions and submitted for review and approval by the Zoning Administrator at the time of site plan submission. 14. The applicant shall submit to the Zoning Administrator for review and approval a revised site plan for the subject site consistent with the approved development conditions for SE-243-99-1 and SU-1453-99-4 within 90 days from the date of the approval of the special exceptions and special use permits. The applicant shall diligently pursue site plan approval through the comment and revision phase of the site plan review process. 15. The applicant shall ensure that all improvements to the subject site necessitated by the City Council approved SE/SUP plan and development conditions are completed within nine months from the date of site plan approval.
