RESOLUTION TO INITIATE AND REFER TO THE PLANNING
COMMISSION AN AMENDMENT TO THE CITY CODE AS FOLLOWS:
ARTICLE XIV, SECTION 26-177(a)(4)(h) TO PROVIDE FOR CITY
COUNCIL WAIVER OR MODIFICATION OF THE REQLqRED FIVE
HUNDRED (500) FOOT SEPARATION BETWEEN MOTOR
VEHICLE SALES, LEASING, AND RENTAL ESTABLISHMENTS IN
THE C-3 ZONING DISTRICT.
WHEREAS, providing for appropriate uses and procedures may stimulate
economic development and enhance the City's commercial districts; and
WHEREAS, regulations regarding separation distance between motor vehicle
sales, leasing and rental establishments inadequately provide for waiver and
modification; and
WHEREAS, consideration of a waiver or modification of the separation distance
is appropriate concurrent with City Council review of special use permits for motor
vehicle sales, leasing and rental establishments;
NOW, THEREFORE, BE IT RESOLVED THAT the City Council of the City of
Fairfax, Virginia, does hereby initiate and refer to the Planning Commission for study,
public heating, and recommendation the proposed amendment to City Code Chapter 26
as stated above.
