19980113 r-98-3RESOLUTION NO. 1998 - R-98-3 RESOLUTION TO DENY THE REQUEST OF ATCO, VA. INC., FOR A SPECIAL EXCEPTION TO CHAPTER 26 OF THE CITY CODE ON THE PREMISES KNOWN AS 11004 AND 11006 PARK ROAD, AND MORE PARTICULARLY DESCRIBED AS TAX MAP PARCELS 57-1- ((2))-135 AND 136. WHEREAS, ATCO, VA. INC. has submitted Application No. SE-210-97-1 requesting Special Exceptions to the City Code as listed below: Section 26-39.2(c) and (e) - to allow elimination of the required separation between structures and parking spaces where a six- foot-wide separation is required; and, elimination of the required seven-foot-wide peripheral parking lot landscaped strip; and, modification of the required 25-foot-wide landscaped strip; and, Section 26-39.4(a)(5) - to allow 14 parking spaces where 32 are required. WHEREAS, City Council has carefully considered the application, the recommendation of the staff and testimony received at the public hearing; and WHEREAS, City Council has determined that the proposed Special Exception is not appropriate because the proposal, does not meet the requisites established by City of Fairfax Code Section 26-39.7 and Section 26-103(c) for the following reason: "The health, safety and welfare of the residents in the area will be impacted by this application." NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fairfax on this 13~ day of January, 1998, that Application No. SE-210-97-1 be and hereby is DENIED. MAYOR .
