R=98-21 RESOLUTION TO APPROVE THE REQUEST OF THE BOYD SCHOOL, BY MARY ANN WOOSLEY, FOR SPECIAL EXCEPTIONS TO CHAPTER 26 OF THE CITY CODE TO ALLOW CONSTRUCTION OF PLAYGROUND EQUIPMENT BETWEEN THE BUILDING RESTRICTION LINE AND THE STREET AND TO ALLOW EXPANSION OF AN OUTDOOR USE WITHOUT SCREENING FROM A RESIDENTIAL ZONE, ON THE PREMISES KNOWN AS 3909 OAK STREET AND MORE PARTICULARLY DESCRIBED AS TAX MAP PARCEL 57-1-((2))-115A. WHEREAS, The Boyd School, by Mary Ann Woosley, has submitted Applications No. SE-216-98-1 requesting a Special Exception to Section 26-168(c)(1) of the City Code and SE-216-98-2 requesting a Special Exception to Section 26-68 of the City Code to allow construction of playground equipment between the building restriction line and the street and to allow expansion of an outdoor use without screening from a residential zone; and WHEREAS, City Council has determined that the proposed Special Exceptions are appropriate because the proposal is consistent with the recommendations of the Comprehensive Plan and meets the requisites established by City of Fairfax Code Section 26-103(c) and 26-168(0; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fairfax on this 122 day of May, 1998, that Applications No. SE-216-98-1 and SE-216- 98-2 be and hereby are APPROVED, with the following four conditions: 1. No play structure shall exceed eight feet in height. The site plan shall comply with the visual clearance provisions of Section 26-14.1 The applicant shall provide the planting component of the screen required by Section 26-68. The play structures, fencing and landscaping shall be submitted to the Board of Architectural Review for its approval to assure that the appearance of such site features is in harmony with the nearby residences.
