R-98-22 RESOLUTION TO APPROVE THE REQUEST OF MAIN STREET SHELL, BY MYRON BONCAROSKY, PRESIDENT/OWNER, FOR A SPECIAL EXCEPTION TO CHAPTER 26 OF THE CITY CODE ON THE PREMISES KNOWN AS 9956 MAIN STREET (MAIN STREET SHELL), AND MORE PARTICULARLY DESCRIBED AS TAX MAP PARCEL 58-3-((2))-H. WHEREAS, Main Street Shell has submitted application No. SE-218-98-1 requesting a Special Exception to modify the City Code listed below: Section 26-44(Table II) - to allow ground-mounted signs with a total maximum area of 59.5 square feet to be located 10 feet from the right-of-way of Main Street. WHEREAS, City Council has determined that the proposed Special Exception is appropriate because the proposal meets the requisites established by City of Fairfax Code Section 26-48 and Section 26-103(c) for the following reasons: The proposed sign will not affect vehicular or pedestrian traffic on or near the subject property. 2. This proposal will not affect trip generation or adjacent uses. The existing landscape and lay of the land in this area would prevent internal illumination or properly dkected floodlighting from adversely affecting nearby residences. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fairfax on this 12th day of May, 1998, that Application No. SE-218-98-1 be and hereby is APPROVED with the following conditions: The applicant shall remove the existing pylon sign structure and combine its sign contents with those of the proposed sign presented with this application, to be presented on a single ground-mounted sign; and The ground-mounted sign shall have a "Total Maximum Area" of no more than 59.5 square feet and a front setback of 10 feet.
