RESOLUTION TO APPROVE THE REQUEST OF ROBERT C.
DEHAVEN ENTERPRISES, LLC, OWNER, FOR A SPECIAL
EXCEPTION TO CHAPTER 26 OF THE CITY CODE ON THE PREMISES
KNOWN AS 9739 LEE HIGHWAY, AND MORE PARTICULARLY
DESCRIBED AS TAX MAP PARCELS 48-3-((2))-18 AND 19.
WHEREAS, Robert C. DeHaven Enterprises, LLC has submitted Application No.
SE-220-98-1 requesting a Special Exception to Section 26-39.5(b)(5) of the City Code,
pursuant to Section 26-39.7, to allow one loading space where two are required.
WHEREAS, City Council has determined that the proposed Special Exception is
appropriate because the proposal meets the requisites established by City of Fairfax Code
Sections 26-103(c) and 26-39.7 and for the following reasons:
The applicant has adequately demonstrated that the special exception
will not negatively affect adjacent property, is not contrary to
Comprehensive Plan objectives, is necessary to permit reasonable use
of the property, and will not result in a negative impact on traffic flow
or pedestrian and vehicular safety.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fairfax
on this 1Th day of May, 1998, that Application No. SE-220-98-1 be and hereby is
APPROVED.
