19980526 r-98-25RESOLUTION NO. R-98- 25 RESOLUTION TO APPROVE THE REQUEST OF CARDINAL FINANCIAL CORPORATION, BY L. BURWELL GUNN, PRESIDENT & C.E.O., FOR SPECIAL EXCEPTIONS TO CHAPTER 26 OF THE CITY CODE ON THE PREMISES KNOWN AS 10641 LEE HIGHWAY, AND MORE PARTICULARLY DESCRIBED AS TAX MAP PARCEL 57-2-((2))-82. WHEREAS, Cardinal Financial Corporation has submitted application No. SE-219- 98-1 requesting a Special Exception to modify the City Code as listed below: Section 26-39.4(b)(3)f - to allow the provision of only four stacking spaces instead of the eight required for a drive-through banking facility; and Section 26-39.2(c) - to allow a separation of only twenty-eight inches instead of the four feet required between a parking facility and the building; WHEREAS, City Council has determined that the proposed Special Exception is appropriate because the proposal meets the requisites established by City of Fairfax Code Section 26-39.7 and Section 26-103(c); NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fairfax on this 26th day of May, 1998, that Application No. SE-219-98-1 be and hereby is APPROVED with the following conditions: The applicant shall provide and maintain a painted stripe on the paving of the drive-though lane separating the lane from the right-of-way of McLean Avenue. J The applicant or operator shall provide and maintain the proposed lane- closing light and shall visually monitor the number of vehicles stacked at all times while the drive-through window is open. o The applicant or operator shall assure that no vehicle waiting for drive- through service hinders or blocks the flow of traffic on McLean Avenue. Substantiated reports of violation of this condition on more than two occasions within any six-month period shall be grounds for revocation of the special exception or imposition of additional conditions, at the discretion of City Council, in accordance with the procedure set forth in Section 26-103(d)(5).
