19980609 r-98-32RESOLUTION NO. 1998- R-98-32 RESOLUTION TO DENY THE REQUEST OF MERRIFIELD CIRCLE CORPORATION, BY JAMES S. AUDIA, PRESIDENT, FOR A SPECIAL EXCEPTION TO CHAPTER 26 OF THE CITY CODE ON THE PREMISES KNOWN AS 3160 SPRING STREET, AND MORE PARTICULARLY DESCRIBED AS TAX MAP PARCEL 48-3-((01))-26A. WHEREAS, Merrifield Circle Corporation has submitted Application No. SE-213- 97-1 requesting a Special Exception to the City Code sections listed below: Section 26-39.4(a)(5) - Section 26-39.4(b)(4) - Section 26-39.2(e) - Section 26-190(b) - to allow 8.5-foot-wide parking spaces where 9-foot- wide parking spaces are required. to allow a reduction of the required parking. to eliminate the required parking lot landscaping. to allow three parking spaces to encroach into the required 25-foot-wide landscaped strip. WHEREAS, City Council has carefully considered the application, the recommendation of the staff and testimony received at the public hearing; and WHEREAS, City Council has determined that the proposed Special Exception is~ not appropriate because the proposal does not meet the requisites established by City ot Fairfax Code Section 26-39.7, Section 26-190(0 and Section 26-103(c) for the following reasons: "Because increased intensity of the use is not in the best interest of the City." NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fairfax on this 9th day of June, 1998, that Application No. SE-213-97-1 be and hereby is DENIED. Adopted this 9th day of dune ,1998.
