A RESOLUTION TO INITIATE CONDEMNATION
PROCEEDINGS FOR A PORTION OF
PROPERTY AT 3603 JERMANTOWN ROAD,
TAX MAP NUMBER 47-$-((2))-6,
OWNED BY FOUR MILE ASSOCIATES, LLC,
JOHN H. AYLOR AND GARY & KAREN LOCKOWANDT,
FOR THE PURPOSES OF CONSTRUCTING
A SIDEWALK ON THE EAST SIDE OF
JERMANTOWN ROAD FROM KUTNER PARK
TO CAROL STREET
WHEREAS, condemnation of a certain property is necessary for the
public purpose of constructing a sidewalk along Jermantown Road, which property
is described in the easement document accompanying the City's offer to purchase
the necessary easement, and which property is owned by Four Mile Associates,
LLC, John H. Aylor, and Gary and Karen Lockowandt.
NOW, THEREFORE, BE IT RESOLVED that staffis hereby
authorized to initiate condemnation proceedings, including possession prior to
conclusion of the condemnation proceedings, if necessary, in accordance with the
appraisals prepared by qualified appraisers, bona fide, but ineffectual, efforts to
purchase the necessary property rights have been made.
