19980623 r-98-36RESOLUTION NO. R-98-36 Whereas, the City Council and Media General Cable of Fairfax County, Inc. ("Media General Cable") are currently negotiating the renewal of the existing cable television franchise; and Whereas, the City Council and Media General Cable (collectively, the "Parties") have agreed to an extension of the current franchisee by five months on order to provide additional time for the Parties to complete the renewal process and to take such other actions as may be appropriate to resolve the issues related to franchise renewal; and Whereas, it is contemplated that during those negotiations there will be discussions involving various new services, technologies and other improvements to the existing cable television system operated by Media General Cable; and Whereas, Media General Cable will need to reveal certain proprietary information concerning those improvements that could adversely affect its competitive position within the industry; and Whereas, the Virginia Freedom of Information Act provides a limited exemption from the disclosure of such proprietary information when such information is provided to a franchising authority pursuant to a promise of confidentiality, Va. Code Anno. § 2.1- 342(B)(68)(Michie Supp. 1997); now, therefore, be it Resolved, that the City Council of the City of Fairfax promises confidentiality for proprietary information submitted by Media General Cable that is within the scope of the exemption by Va. Code Anno. § 2.1-342(B)(68) for which Media General Cable has taken steps to protect in accordance with the exemption provided therein Adopted this 23rd day of June, 1998.
