RESOLUTION TO DENY THE REQUEST OF CMD REALTY
INVESTORS, INC., BY DAVID G. LANGOL, VICE PRESIDENT, FOR
A SPECIAL EXCEPTION TO MODIFY CITY CODE SECTION 26-45(b)
TO ALLOW DISPLAY OF A REAL ESTATE SIGN FOR COMMERCIAL
PROPERTY AFTER LEASING SEVENTY-FIVE PERCENT OF THE
GROSS LEASABLE AREA OF THE ESTABLISHMENT ON PROPERTY
LOCATED AT 9990 LEE HIGHWAY AND FURTHER IDENTIFIED AS
TAX MAP PARCEL 48-3-((2))-1.
WHEREAS, CMD Realty Investors, Inc., by David G. Langol, Vice President,
has submitted Application No. SE-225-98-1 requesting a Special Exception to modify
city code section 26-45(b) to allow display of a real estate sign for commercial property
after leasing seventy-five percent of the gross leasable area of the establishment; and
WHEREAS, City Council has determined that the proposed Special Exception is
not appropriate because the proposal does not meet the requisites for approval of special
exceptions established by City of Fairfax Code Sections 26-48 and Section 26-103(c)(1-
13)
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Fairfax on this 28ta day of July 1998, that Application No. SE-225-98-1 be and hereby is
DENIED.
