RESOLUTION TO DENY THE REQUEST OF SAMAHA ASSOCIATES,
P.C., AGENT FOR THE CITY OF FAIRFAX SCHOOL BOARD, FOR A
SPECIAL EXCEPTION TO CHAPTER 26 OF THE CITY CODE ON
THE PREMISES KNOWN AS LAYTON HALL ELEMENTARY
SCHOOL, 3705 OLD LEE HIGHWAY, AND MORE PARTICULARLY
DESCRIBED AS TAX MAP PARCEL 57-2-((2))-182.
WHEREAS, Samaha Associates, P.C. has submitted application No. SE-224-98-1
requesting a special exception to modify Section 26-65 of the City Code to modify the tree
canopy cover requirement for development in the R-2 residential district.
WHEREAS, City Council has determined that the proposed special exception is
not appropriate because the proposal does not meet the requisites established by City of
Fairfax Code Section 26-71.2 and Section 26-103(c) because a simple solution is available
for meeting the tree canopy cover standard set by City Code;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Faiffax on this 28t~ day of July, 1998, that Application No. SE-224-98-1 be and hereby is
DENIED.
