19970311 r-97-5RESOLUTION NO. R-97- 5 RF_~OLUTION TO APPROVE THE REQUEST OF MAYFAIR PARTNERS, L.P., T/A BOSTON MARKET, BY WILLIAM C. THOMAS, JR., AGENT, FOR SPECIAL EXCEPTIONS PURSUANT TO CITY CODE SECTIONS 26- 44(b)(2)al, 2 and 3 TO ALLOW A BUILDING-MOUNTED SIGN ON THE SIDE OF THE BUILDING NOT DEFINED AS BUILDING FRONTAGE, TO ALLOW BUILDING-MOUNTED SIGNAGE THAT EXCEEDS THE AMOUNT PERMITTED BY THE CITY CODE AND TO DENY THE REQUEST FOR A GROUND-MOUNTED SIGN FOR AN INDIVIDUAL BUSINESS SITUATED WITHIN A SHOPPING CENTER ON TIlE PREMISES KNOWN AS 4090 JERMANTOWN ROAD, AND MORE PARTICULARLY DESCRIBED AS A PORTION OF TAX MAP PARCEL 56-2-((8))-26C. WHEREAS, Mayfair Partners, L.P., T/A Boston Market, by William C. Thomas, Jr., Agent, has submitted Application SE-180-96-1 requesting special exceptions to the City Code listed below: Section 26-44Co)(2)al to allow a building-mounted sign on the side of the building not defined as building frontage. Section 26-44Co)(2)a2 to allow building-mounted signage that exceeds the amount permitted by the City Code. Section 26-44(b)(2)a3 to allow a ground-mounted sign for an individual business situated within a shopping center. WHEREAS, City Council has determined that the first two of the proposed special exceptions are appropriate because the proposals meet the requisites established by City of Falrfax Code Section 26-103(c), while the third does not. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fairfax on this llth day of March, 1997, that the requested special exceptions from Section 26-44(b)(2)al and 2 are hereby approved. BE IT FURTHER RESOLVED THAT the requested special exception from Section 26-44(b)(2)a3 is hereby DENIED. ATTEST: I ci/dCle
