19970325 r-97-08RESOLUTION NO. R-97-8 RESOLUTION TO APPROVE THE REQUEST OF MAIN STREET MOBIL, BY WILLIAM E. PICKENS, AGENT, FOR APPROVAL OF A SPECIAL EXCEPTION TO CHAPTER 26 OF THE CODE OF THE CITY OF FAIRFAX ON THE PREMISES KNOWN AS 10423 MAIN STREET AND MORE PARTICULARLY DESCRIBED AS TAX MAP PARCEL 57-4-((23))-91. WHEREAS, Main Street Mobil, by William E. Pickens, Agent, has submitted Application SE-193-97-1 requesting a special exception pursuant to City Code Section 26-209.3(0 to allow a modification of the required 10-foot ~ront yard required by Section 26-209.3(c)(1) to allow construction of a canopy that overhangs a portion of the required front yard, and WHEREAS, City Council has determined that the proposed special exception is appropriate because the proposal meets the requisites established by City of Fairfax Code Section 26-103(c), NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fairfax on this 25th day of March, 1997, that the requested special exception from Section 26-209.3(f) is APPROVED with the following conditions: That the location of the overhang of the proposed canopy be no closer than 4 feet from the right-of-way of Main Street; That the existing sign be re-mounted at ground level with additional landscaping and allowing for emblishment of the sign. That the applicant provide additional landscaping adjacent to the private sidewalk at the northwest coruer of the building; That the applicant prov/de brick pedestrian paving at the northwest corner of the site adjacent to the public sidewalk; and That the applicant provide a 24-inch to 36-inch high brick wall to separate on-site vehicular movement from public pedestrian areas along Main Street, except at the defined vehicular site entrances. ~ ~YOR ATTEST:
