R-97-13 RESOLUTION TO APPROVE, WITH CONDITIONS, THE REQUEST OF AT&T FOR AUTHORIZATION OF A VARIANCE FROM THE HEIGHT LIMITATIONS OF CHAFEER 26 OF THE CODE OF THE CITY OF FAIRFAX ON THE PREMISES KNOWN AS 9780 MAIN STREET AND MORE PARTICULARLY DESCRIBED AS TAX MAP PARCEL 58-3-((2))-028. WHEREAS, AT&T has submitted Application V-1123-97-1 requesting a variance pursuant to City Code Section 26-225 to allow a modification of the height restrictions for radio/television structures provided by Section 26-12(b) to allow the attachment of nine panel antennas, each five feet tall, to the existing water tower on the premises, and WHEREAS, City Council has determined that the proposed variance is warranted because the proposal meets the requisites established by City of Fairfax Code Section 26- 220(b), NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fairfax on this twenty-second day of April, 1997, that the requested variance from Section 26-12(b) is AUTHORIZED with the following conditions: The Applicant shall revise the site plan to rotate the 20-foot length of the concrete pad to be oriented parallel to Main Street with a 5-foot offset from the existing building on the site; The Applicant shall revise the location of the panel antennas to be on the opposite side of the wiring shroud, as shown on the exhibits for the license agreement; o The Applicant shall revise the plans to place underground the wiring that connects the electronic equipment cabinet with the antennas; and Prior to building permit approval, Applicant shall obtain the approval of a complete set of construction drawings, signed and sealed by a Professional Engineer, from the Director of Utilities to ensure that the proposed use and facilities will not have a negative impact on the operations and maintenance of the water storage facility.
