19970422 r-97-14RESOLUTION NO. R-97-14 RESOLUTION TO APPROVE, WITH CONDITIONS, THE REQUEST OF EXXON CORPORATION, BY FRANK W. STEARNS, AGENT, FOR SPECIAL EXCEPTIONS TO CHAPTER 26 OF THE CODE OF THE CITY OF FAIRFAX, VIRGINIA, ON THE PREMISES KNOWN AS 10485 LEE HIGHWAY, AND MORE PARTICULARLY DESCRIBED AS A PORTION OF TAX MAP PARCEL 57-1-((2))-000C. WHEREAS, Exxon Corporation, by Frank W. Stearns, agent, has submitted Application SE-186-96-1 requesting special exceptions to the City Code listed below: Section 26-39.4(3)(a) to allow six (6) parking spaces where ten (10) are required; Section 26-173(c)(2) to allow encroachment into the side yard setback; Section 26-173(c)(1) to allow less than the required 25-foot front yard; and WHEREAS, City Council has determined that the proposed special exceptions, with conditions, are appropriate because the proposal meets the requisites established by City of Fairfax Code Sections 26-103(c), 26-39.7, 26-173(0(1)(2); NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fairfax on this 22nd day of April, 1997, that the requested special exceptions are hereby APPROVED with the following conditions: The westernmost entrance on Lee Highway shall be relocated in substantial accord with the revised plat dated April 22, 1997. Further, the easternmost entrance shall be closed by the applicant in conjunction with any effort by the adjacent property owner to close its portion of said entrance. The applicant shall complete such action within 90 days of a request by the City, or such longer period approved by the Director of Public Works. Three decorative acorn style street lights be installed along the Chain Bridge Road and Lee Highway frontages consistent with the Community Appearance Plan. City Clerk ( k3 c e, ,;~ ~ ')
