RESOLTUION TO DENY THE REQUEST OF 10900 LEE HIGHWAY
ASSOCIATES LIMITED PARTNERSHIP, BY WILLIAM C. THOMAS,
JR., AGENT, FOR SPECIAL EXCEFFIONS TO CHAPTER 26 OF THE
CITY CODE ON THE PREMISIS KNOWN AS 10900 LEE HIGHWY
AND MORE PARTICULALRY DESCRIBED AS TAX MAP PARCEL
57-1-((2))-47.
WHEREAS, 10900 Lee Highway Associates Limited Partnership has submitted
Application No. SE-207-97-1 requesting Special Exceptions to the City Code listed below:
Section 26-46(m) - To allow a 16-foot high pylon sign; and
Section 26-173(c)(1) - To allow the sign to be set back only 12 feet from
the right-of-way of Lee Highway.
WHEREAS, City Council has determined that the proposed Special Exceptions are
not appropriate because the proposal does not meet the requisites for approval of special
exceptions established by City of Fairfax Code Section 26-48, Section 26-173(0 and
Section 26-103(c)(1-13) because the proposal is inconsistent with the goals, objectives and
strategies of the Comprehensive Plan and with the Community Appearance policy for
existing nonconforming signage.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Fairfax on this 11t~ day of November, 1997, that Application No. SE-207-97-1 be and
hereby is DENIED.
