R- 9 7 - 5 ~ A RESOLUTION REQUESTING THE 1998 SESSION OF THE VIRGINIA GENERAL ASSEMBLY TO ENACT AN AMENDMENT TO CHAPTER 2, SECTION 2.7 OF THE CITY CHARTER OF THE CITY OF FAIRFAX, VIRGINIA, TO GRANT THE CITY COUNCIL OF THE CITY OF FAIRFAX QUICK TAKE AUTHORITY FOR BLIGHTED COMMERCIAL PROPERTIES BY ADDING SECTION 2.7(D) TO ITS EXISTING POWERS OF EMINENT DOMAIN. WHEREAS, at a regular meeting of the City Council held on December 9, 1997, after due and proper publication of the notice of public hearing pursuant to § 15.1-835, Code of Virginia (1950), as amended, which notice contained inter alia, an informative summary of the proposed amendment of the City Charter of the City of Fairfax a public hearing with respect to the proposed amendment was held before the City Council in which all citizens so desiring were afforded the opportunity to be heard to determine if the citizens of the City desire that the City request the General Assembly to amend its existing Charter in the form and manner hereinafter referred to and as provided in the aforesaid notice; and WHEREAS, upon conclusion of such public hearing and upon consideration of the proposed amendment to such Charter, the City Council is of the opinion that the 1998 General Assembly of Virginia should be requested to amend the City Charter as hereinafter set forth. NOW THEREFORE, BE IT RESOLVED, by the City Council of the City of Fail-fax, that the General Assembly of Virginia is hereby requested during the 1998 session to amend the City Charter of the City of Fairfax, Virginia (the "City Charter") as follows: Amend Chapter 2, by adding Section 2.7(d) to the City Charter to read as follows: Sec. 2.7(d). Further, the city may exercise the power of eminent domain as provided in either Title 15.2, Title 25 and Title 33.1 for revitalization of blighted commercial properties including the authority to issue certificates and take immediate title pursuant to Title 33.1, Sections 33.1-119 and Section 33.1-121-129.
