19960123 r-96-2RESOLUTION NO. R-96-2 RESOL~ON TO APPROVE THE REQUEST OF FAIRFAX RACQUET CLUB, INC. BY DAVID S. HOUSTON, AGENT, FOR A SPECIAL EXCEPTION TO CITY CODE SECTION 27-173(c)(1) - TO ALLOW A FRONT YARD TO BE LESS THAN THE REQUIRED 25-FOOT SETBACK FOR A NEW COMMERCIAL RECREATIONAL FACILITY ON THE PREMISES KNOWN AS 9860 LEE HIGHWAY, AND MORE PARTICULARLY DESCRIBED AS TAX MAP PARCEL 48-3-((2))-2. WHEREAS, Fairfax Racquet Club, Inc. has submitted Application No. SE-171-96-2 requesting a Special Exception to the City Code listed below: Section 26-173(c)(1) - To allow a front yard to be less than the required 25-foot setback for a new commercial recreational facility. WHEREAS, City Council has determined that the proposed Special Exception is appropriate because the proposal meets the requisites established by City of Fairfax Code Section 26-173(0 for the following reasons: The proposed building restricts all noise and illumination to within the the permanent facility and eliminates any adverse impact on the nearby residential areas, and The proposed building will enhance the safe operation of this existing use. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fairfax on this 23th day of January, 1996, that Application No. SE-171-96-2 be and hereby is APPROVED. ATTF_ST:
