19960123 r-96-3RESOLUTION NO. R-96-3 RF_SOLUTION TO APPROVE THE REQUEST OF TRURO EPISCOPAL CHURCH, BY DIANE D. HILL TURRELL, AGENT, FOR A SPECIAL EXCEFFION TO CITY CODE SECTION 26-43(a)(1) - TO ALLOW AN OFF-SITE GROUND-MOUNTED SIGN TO BE LOCATED, ON THE PREMISES KNOWN AS 10480 MAIN STREET, AND MORE PARTICULARLY IDENTIFIED AS 57-4-((2))-79. WHEREAS, Truro Episcopal Church has submitted Application No. SE-169-96-1 requesting a Special Exception to the City Code listed below: Section 26-43(a)(1) - To allow a ground-mounted sign to located on property not on the same lot as the principal use (church). WHEREAS, City Council has determined that the proposed Special Exception is appropriate because the proposal meets the requisites established by City of Fairfax Code Section 26-48 for the following reasons: The proposed sign will enhance the safety and movement of vehicular traffic upon adjacent streets; The proposed sign will mitigate the negative impact of the existing vegetation and enhance the visibility of the church site; and The proposed sign is consistent with the Old Town Fairfax Historic Overlay District Design Guidelines. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fairfax on this 23th day of January, 1996, that Application No. SE-169-96-1 be and hereby is APPROVED, with the following conditions: The applicant enter into an amendment to the existing reciprocal agreement between the City and the applicant or enter into a separate agreement with the City permitting the applicant to erect a sign on the subject property, which amendment or agreement should be subject to conditions reasonably stipulated by the City. The proposed sign be placed at a location in the northeast portion of the property, not closer than ten (10) feet from the public right-of-way, and in a specific location subject to prior approval by the Director of Public Works. The special exception be valid for a period of five (5) years; provided, however, that the continuation of the special exception is conditioned upon the existence of a continuing, valid agreement between the applicant and the City concerning the placement of the sign. If the agreement is terminated, the special exception shall automatically terminate. ATFEST:
