R-96-48 A RESOLUTION ADOPTING A POLICY AND PROCEDURE FOR THE INSTALLATION OF SIGNS ADVISING THE PUBLIC OF THE MAXIMUM SPEED LIMIT AND MAXIMUM PENALTY FOR EXCEEDING THE POSTED MAXIMUM SPEED LIMIT IN CERTAIN RESIDENCE DISTRICTS. WHEREAS, the City Council recognizes that speeding in residential neighborhoods presents serious safety problems for the residents of those neighborhoods; and WHEREAS, the City Council supports strategies to reduce these safety problems; and WHEREAS, the General Assembly of Virginia, during the 1996 session, enacted VA Code Section 46.2-878.2 and determined that the penalty for exceeding the posted maximum speed limit should be increased in certain residence district, as defined in State law, when indicated by appropriately placed signs displaying the posted speed limit and the penalty for violations; and WHEREAS, VA Code Section 46.2-878.2 requires the Commonwealth Transportation Board ("CTB") to develop criteria for overall applicability for the installation of such signage; and WHEREAS, the CTB has developed such criteria which has been considered by the City staff; and WHEREAS, a City Policy and Procedure for the applicability for the installation of such signage has been developed in accordance with VA Code Section 46.2-878.2 and is attached to this Resolution. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fairfax, that the attached Policy and Procedure for Applicabi- lity of Section 46.2-878.2 of the Code of Virginia for the Installation of Signs Advising the Public of the Maximum Speed Limit and the Maximum Penalty for Exceeding the Posted Maximum Speed Limit in Certain Residence Districts under the jurisdiction of the City of Fairfax is hereby adopted.
