19961126 r-96-52RESOLUTION NO. R-96-52 RESOLUTION TO APPROVE THE REQUEST OF COSMOS BELLS, OWNER/AGENT, FOR A SPECIAL EXCEPTION TO CHAPTER 26 OF THE CITY CODE ON THE PREMISES KNOWN AS p.J. SKIDOO'S RESTAURANT, AND MORE PARTICULARLY DESCRIBED AS TAX MAP PARCELS 48-3-((14))-002A. WHEREAS, Cosmos Bells, owner/agent for P.J. Skidoo's restaurant, has submitted Application No. SE-185-96-1 requesting a Special Exception to the City Code as listed below: Section 26-46(m) - to allow a pylon sign that is otherwise not permitted. WHEREAS, City Council has determined that the proposed Special Exception is appropriate, as modified, because the proposal meets the requisites established by City of Fairfax Code Section 26-48 and Section 26-103(c) for the following reasons: 1. The special exception will not be inconsistent with the comprehensive plan or the purpose of the sign ordinance; and, The location of the existing building (large setback) and parking areas (no landscape strip available in which the sign may be located) make ground-mounted and building-mounted signage ineffective. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fairfax on this 26th day of November, 1996, that Application No. SE-185-96-1 be and hereby is APPROVED with the following conditions: The sign shall not exceed 11 feet in height and shall not exceed 51 square feet in area and shall be installed consistent with all other design specifications submitted and revised through September 20, 1996. 2. The proposed sign and sign cover shall not extend into or over the public right-of-way. 3. The parking spaces on either side of the proposed sign shall be designated as compact car spaces.
