R-95- 2 RESOLUTION TO DENY THE REQUEST OF MORRISON RESTAURANTS, T/A RUBY TUESDAY, BY ROBIN BABROFF, AGENT, FOR SPECIAL EXCEPTIONS TO CHAPTER 26 OF THE CITY CODE ON THE PREMISES KNOWN AS RUBY TUESDAY, 9444 ARLINGTON BOULEVARD, AND MORE PARTICULARLY DESCRIBED AS TAX MAP PARCEL 48-3-((2))-11. WHEREAS, Morrison Restaurants, Inc., t/a Ruby Tuesday, by Robin Babroff, Agent, has submitted Application No. SE-150-94-1 requesting a Special Exception to the City Code listed below: Section 26-44(b)(2)a3 to allow two additional building-mounted signs to be attached on building walls not defined as building frontage and to exceed the allowable square footage. WHEREAS, City Council has carefully considered the application, the recommendation of the staff and testimony received at the public heating; and WHEREAS, City Council has determined that the proposed Special Exception is not appropriate because the proposal does not meet the requisites established by City of Fairfax Code Sections 26-48 and 103(c), because the existing building signage is considered adequate. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fairfax on this 10th day of January, 1995, that Application No. SE-150-94-1 be and hereby is DENIED ATTEST:
