19950124 r-95-4RESOLUTION NO. R-95- 4 RESOLUTION TO APPROVE THE REQUEST OF JOHN HANCOCK MUTUAL LIFE INSURANCE COMPANY BY R.A. PAYNE & ASSOCIATES, MANAGING AGENT, FOR A SPECIAL EXCEPTION TO CHAPTER 26 OF THE CITY CODE ON THE PREMISES KNOWN AS THE MOSBY OFFICE BUILDING, 105~60 MAIN STREET, AND MORE PARTICULARLY DESCRIBED AS TAX MAP PARCEL 57-2-((02))-156. WHEREAS, John Hancock Mutual Life Insurance Company by R.A. Payne & Associates, Inc., Managing Agent, has submitted Application No. SE-151-94-1 requesting a Special Exception to the City Code listed below: Section 26-43(a)(3) and (8) to allow a ground-mounted sign to he less than the required 20 feet from the property line and public right-of-way. WHEREAS, City Council has determined that the proposed Special Exception is appropriate because the proposal meets the requisites established by City of Fairfax Code Section 26-103(c) for the following reasons: Due to the significant changes in topography immediately adjacent to Main Streel and the proximity of the building to the street, the applicant suffers a unique burden; 2. No negative impacts will occur as a result of granting the request; and o The proposal is consistent with the Comprehensive Plan and the purpose of the Sign Ordinance to provide for adequate, well-designed signage. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fairfax on this 24th day of January, 1995, that Application No. SE-151-94-1 be and hereby is APPROVED, with the condition that the applicant obtain subsequent approval by the Board of Architectural Review.
