A RESOLUTION AMENDING THE CITY OF FAIRFAX
SCHEDULE OF RATES AND LEVIES, 1994-1995, TO
INCREASE THE FIRE PREVENTION (HAZARDOUS USE
PERMIT) FEES FOR THE STORAGE OF FLAMMABLE AND
COMBUSTIBLE LIQUIDS
WHEREAS, the City Council for the City of Fairfax, Virginia,
has determined that it is necessary to increase the fire prevention
(hazardous use permit) fees for the bulk storage of flammable and
combustible liquids;
WHEREAS, this action is taken after advertisement of such
proposed action, and a public hearing hereon; and
WHEREAS, the City Council finds:
1.) The handling and bulk storage of flammable and combusti-
ble liquids can be a danger to the health and welfare of residents
of the City due to violations of statutory and regulatory require-
ments;
2.) Previous inspections of large, complex facilities engaged
in the bulk storage and handling of flammable and combustible
liquids have revealed violations of provisions of the Statewide
Fire Prevention Code as amended by the Fairfax City Code;
3.) Compliance with all applicable provisions of the
Statewide Fire Prevention Code as amended by the Fairfax City Code
is a prerequisite for issuance of a hazardous use permit and a
condition of continued operation under such a permit;
4.) The City has determined that enhanced enforcement of the
Statewide Fire Prevention Code and the Hazardous Use Permit program
is necessary to guard against unsafe conditions and to enhance the
health, safety and welfare of the City, its inhabitants, and the
facilities themselves;
5.) The City has incurred and will continue to incur substan-
tial expenses to enforce the Statewide Fire Prevention Codes and
the Hazardous Use Permits issued pursuant to that Code.
NOW, THEREFORE, BE IT RESOLVED by the City Council for the
City of Fairfax, Virginia, that the City of Fairfax Schedule of
Rates and Levies, 1994-95, approved by the City Council on June 28,
1994, is hereby amended, in part, to read as follows:
