19950627 r-95-16RESOLUTION NO. R-95- 16 RESOLUTION TO APPROVE THE REQUEST OF FIRST UNION NATIONAL BANK OF VIRGINIA, PROPERTY OWNER, BY BROCK C. EUSTICE, OF SHERIDAN, BEHM, EUSTICE AND ASSOCIATES, LTD., ARCHITECTS, FOR A SPECIAL EXCEPTION TO CHAPTER 26 OF THE CITY CODE ON THE PREMISES KNOWN AS 10501 MAIN STREET, AND MORE PARTICULARLY DESCRIBED AS TAX MAP PARCEL 57-4-((2))-076. WHEREAS, First Union National Bank of Virginia, Lessee, by Brock C. Eustice of Sheridan, Behm, Eustice and Associates, Ltd. has submitted Application No. SE-160-95-1 requesting a Special Exception to the City Code listed below: Section 26-69(a)(1) to allow a five-foot perimeter parking lot landscape strip where a seven-foot strip is required. WHEREAS, City Council has carefully considered the application, the recommendation of the staff and testimony received at the public hearing; and WHEREAS, City Council has determined that the proposed Special Exception is appropriate because the proposal meets the requisites established by City of Fairfax Code Sections 26-71.2 and 26-103(c) for the following reasons: There is an extraordinary circumstance in the history of the site's design that makes the Special Exception request appropriate. The proposed changes to the site are consistent with the recommendations of the Comprehensive Plan and the Community Appearance Plan. The proposed changes will not have a negative impact on the adjoining properties or on vehicular and pedestrian traffic conditions. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fairfax on this 27th day of June, 1995, that Application No. SE-160-95-1 be and hereby is APPROVED, with the following conditions: In conjunction with formal submission of a site plan, the applicant shall submit a drainage plan for review and approval by the Director of Public Works. Development of the site shall be in general conformance with the site plan submitted May 11, 1995 and revised through June 19, 1995. ATTEST: lex~
