R-94- 15 RESOLUTION TO APPROVE THE REQUEST OF FARRISH OLDSMOBILE, INC., BY KEVIN FARRISH, VICE PRESIDENT, FOR SPECIAL EXCEPTIONS TO CHAPTER 26 OF THE CITY CODE ON THE PREMISES KNOWN AS FARRISH JEEP EAGLE, 9596 LEE HIGHWAY (TAX MAP PARCEL 48-3-((9))- lB) AND FARRISH OLDSMOBILE, 9610 LEE HIGHWAY (TAX MAP PARCEL 48-3-((9))-1). WHEREAS, Farrish Oldsmobile, Inc., by Kevin Farrish, Vice President, has submitted application No. SE-134-94-1 requesting Special Exceptions to the City Codes listed below: Section 26-43(a)(3) and (8) and Table II - To allow a free-standing sign to be closer than the required 20 feet from the public right-of-way and all property lines (the sign at 9610 Lee Highway will have a six-foot setback from the Lee Highway right-of-way and front property line; and the sign at 9596 lee Highway will have a six-foot setback from Lee Highway and the front property line, and an approximately four- foot setback from the west property line); and Section 26-44(a) and Table II - To allow a sign height greater than the permitted six feet (the sign at 9610 Lee Highway will be nine feet in height); WHEREAS, City Council has determined that the proposed Special Exceptions are appropriate because the proposal meets the requisites established by City of Fairfax Code Sections 26-48(b) and 26-103(c) for the following reasons: Both of the properties have existing site layouts that restrict placement of ground-mounted signs that will meet required setbacks and be visible to motorists traveling on ~ Highway. The proposed signs are attractive and meet the objective of the Comprehensive Plan to provide for well-designed signage. o The proposal meets the intent of the Zoning Ordinance to provide for adequate but not excessive signage. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fairfax on this 10th day of May, 1994, that application No. SE-134-94-1 be and hereby is APPROVED. ATTEST: i City C~k ' -
