RESOLUTION TO APPROVE THE REQUEST OF THE CITY OF FAIRFAX, BY
GARY A. MESARIS, FIRE CHIEF, FOR SPECIAL EXCEPTIONS TO CHAPTER 26
OF THE CITY CODE ON THE PREMISES KNOWN AS FIRE STATION//3, 4081
UNIVERSITY DRIVE (TAX MAP PARCEL 57-4-((02))-042A).
WHEREAS, the City of Fairfax, by Gary A. Mesaris, Fire Chief, has submitted
application No. SE-138-94-1 requesting Special Exceptions to the City Code listed below:
Section 26-39. l(h)(3) to allow an increase in the existing gross floor area by more than
30% without making all of the required improvements to the existing nonconforming
parking lot; and
Section 26-213.2Co) to allow walls of a structure to be exposed more than the permitted
43 feet above the finished grade.
WHEREAS, City Council has determined that the proposed Special Exceptions are
appropriate because the proposal meets the requisites established by City of Fairfax Code
Sections 26-39.7, 26-103(c) and 26-213.2(0 for the following reasons:
The proposal is consistent with the objectives of the Comprehensive Plan to
adequately maintain City facilities and City services, and to encourage the
upgrade and renovation of older structures.
2. The proposal is compatible with the surrounding environment.
No negative impacts are anticipated as a result of granting the proposed Special
Exceptions.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fairfax on
this 13th day of September, 1994, that application No. SE-138-94-1 be and hereby is
APPROVED.
