R-94- 46 RESOLUTION TO APPROVE THE REQUEST OF SATURN OF FAIRFAX, INC., BY MANNY GOETZ, DIRECTOR, FOR SPECIAL EXCEPTIONS TO CHAPTER 26 OF THE CITY CODE, ON THE PREMISES KNOWN AS SATURN OF FAIRFAX, 9596 LEE HIGHWAY, AND MORE PARTICULARLY DESCRIBED AS TAX MAP PARCEL 48-3-((09))-001B. WHEREAS, Saturn of Fairfax, Inc., by Manny Goetz, Director, has submitted Application No. SE-146-94-1 requesting Special Exceptions to the City Code listed below: Section 26-39. l(h)(2) and (3) To allow a building expansion which increases the amount of required parking and gross floor area by more than 30% without all of the required improvements to the existing parking lot; Section 26-39.2(c) To allow drive-lanes and parking area to be adjacent to a building without the required separation; Section 26-39.4(a)(5) To allow parking spaces and drive aisles that do not meet minimum dimensional requirements; Section 26-39.4(b)(3)k To allow less than the required number of parking spaces; and Section 26-178(c)(2) to allow less than the required 25-foot side yard. WHEREAS, City Council has determined that the Special Exceptions to Sections 26- 39. l(h)(2)and (3), Section 26-39.4(b)(3)k, and Section 26~178(c)(2) are appropriate because, as modified by the below-stated conditions, they meet the requisites established by City Code Sections 26-39.7, 26-103(c) and 26-178(c) for the following reasons: The Special Exceptions will not cause negative impacts to the surrounding area; The Special Exceptions are consistent with the objective of the Comprehensive Plan to upgrade older properties; and The Special Exceptions allow reasonable use of the property. WHEREAS, City Council further has determined that the Special Exceptions to City Code Sections 26-39.2(c) and 26-39.4(a)(5) are not appropriate because the Special Exceptions are not required for the development plan submitted with Application No. SE-146-94-1. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fairfax on this 25th day of October, 1994, that Application No. SE-146-94-1 be and hereby is APPROVED as outlined above with the following conditions: 2. 3. 4. Additional landscaped areas be provided on either side of the vehicle display parking; The side setback provided on the west side of the proposed addition be no less than 16 feet; The Draper Drive storage lot be maintained for new car delivery and vehicle storage, and a copy of the lease accompany the site plan submission; and The access to Roanoke Street via the Farrish storage lot behind the applicant's property be maintained and noted on the site plan.
