19941115 r-94-49RESOLUTION NO. R-94- 49 RESOLUTION TO APPROVE THE REQUEST OF MT. CALVARY BAPTIST CHURCH, BY ROBERT J. NASH, FAIA & ASSOCIATES, FOR SPECIAL EXCEPTIONS TO CHAPTER 26 OF THE CITY CODE ON THE PREMISES KNOWN AS MT. CALVARY BAPTIST CHURCH, 4325 CHAIN BRIDGE ROAD, AND MORE PARTICULARLY DESCRIBED AS TAX MAP PARCEL 57-4-((02))-012. WHEREAS, Mt. Calvary Baptist Church, by Robert J. Nash, FAIA & Associates, P.C. Agent, has submitted Application No. SE-148-94-1 requesting Special Exceptions to the City Codes listed below: Sections 26-69(a)(1)a and 26-108(c)(1) - to allow less than the required 50-foot fron' setback; Sections 26-69(a)(1)b and 26-108(d)(1) - to allow less than the required 15-foot side setback; Section 26-39.1 (c) - to allow a portion of the required parking spaces to be provided off- site; and Section 26-39. l(h) - to allow a building expansion which exceeds 30% of the existing gross floor area without all of the required improvements to the existing nonconforming parking lot. WHEREAS, City Council has determined that the proposed Special Exceptions are appropriate because, as modified by the below-stated conditions, the proposal meets the requisites established by City of Fairfax Code Sections 26-39.7, 26-71.2, 26-103(c), and 26- 103.3(e) for the following reasons: o The proposal will not negatively affect existing traffic patterns or surrounding properties; Approval of the proposal is not contrary to the objective of the Comprehensive Plan to encourage the upgrade and improvement of older nonconforming properties; The requested Special Exceptions are necessary to allow the existing church facility to be reasonably updated. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fairfax on this 15th day of November, 1994, that Application No. SE-148-94-1 be and hereby is APPROVED with the following conditions: 2. 3. 4. The eastern perimeter landscape strip be planted with a row of shrubs or small trees. The landscape strip behind the fenced storage area be weeded and replanted as appropriate. The off-site parking be maintained as described in the application and be noted on the plan submitted for site plan approval.
