A RESOLUTION TO APPROVE THE REQUEST OF KAMI MORADI, SOLE
PROPRIETOR, FOR A SPECIAL EXCEPTION TO SECTION 26-44(b)(4)(a)
TABLE III, TO ALLOW A BUILDING MOUNTED SIGN TO BE INSTALLED ON
THE BUILDING WALL AT A HEIGHT GREATER THAN THE PERMITTED 3.5
FEET ABOVE THE FINISHED FLOOR LEVEL OF THE SECOND STORY
AT THE SOCCER PRO SHOP, 3936 OLD LEE HIGHWAY.
WHEREAS, Kami Moradi, Sole Proprietor, has submitted
Application No. SE-112-93-1, requesting a special exception to
City Code Section 26-44(b)(4)(a) Table III, in order to allow
a building mounted sign to be installed on a building wall in
a location higher than 3.5 feet above the finished floor level
of the second story;
WHEREAS, City Council has determined that the proposed
special exception is appropriate because the proposal meets the
requisites established by City of Fairfax Code Section 26-48 for
the following reasons:
The design of the front facade of the applicant's
building severely limits the placement of adequate
signage on the building;
Granting the request special exception is not
inconsistent with the Comprehensive Plan or purpose
of the City's sign regulations to provide for adequate
but not excessive signage; and
No negative impacts are anticipated as a result of
granting the special exception.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Fairfax on this 25th day of May, 1993, that application
No. SE-112-93-1 be and hereby is approved, with the condition
that the sign be designed and installed as approved by the Board
of Architectural Review on May 5, 1993.
