R-93-23 A RESOLUTION TO APPROVE THE REQUEST OF EXXON CORPORATION FOR SPECIAL EXCEPTIONS TO THE CODE OF THE CITY OF FAIRFAX, VIRGINIA, FOR PROPERTY LOCATED AT 10480 LEE HIGHWAY. WHEREAS, Exxon Corporation, by R.W. Hilchey, agent and market development manager, has submitted application No. SE-91-92-1 requesting the following special exceptions to the Code of the City of Fairfax: Section 26-19.3 - To allow redevelopment within a Chesapeake Bay Resource Management area that is located within a floodplain. Section 26-47(e)(6) - To allow continuation of a non- conforming sign after the principal use is demolished. Section 26-69(a)(1)¢a) to allow less than the required 25-foot landscaped front yard (width of proposed front yard varies). Section 26-173(c)(1) to allow a front setback less than the required 25 feet (width of the proposed front setback varies.) WHEREAS, City Council has determined that the requested special exceptions to City of Fairfax Code Sections 26-19.3, 126-69(a)(1) (a) and 26-173(c) (1) are appropriate because the request ~meets the requisites established by the City of Fairfax Code for the following reasons: The proposed redevelopment will reduce the existing non- conformities of the site; and The proposed redevelopment is expected to improve conditions in the floodplain and the micro-environment of the site; and Granting the special exceptions will not negatively affect surrounding or downstream properties, or individuals living and working in the area. WHEREAS, City Council has determined further that the requested special exception to city of Fairfax Code Section 26-47(e)(6) is not appropriate because the request does not meet the requisites established by City of Fairfax Code Section 26-48 as follows: The applicant did not clearly demonstrate that the City Code requirements for signage present an undue burden; and Granting such a request would be inconsistent with the purpose of City sign regulations and the Comprehensive Plan. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fairfax on this 8th day of June, 1993, that application No. SE- 91-92-1 be and hereby is approved with the following conditions: The applicant provide stormwater management facilities, including an oil-grit separator as approved by the Public Works Director. R-93-23 -2- Se The oil-grit separator must be cleaned four times a year, or more if deemed necessary by the Public Works Director. The underside of the building's floor must be 18 inches above the floodplain elevation, and the building flood proofed in accordance with the National Flood Insurance Program and Uniform Statewide Building Code. The parking spaces along the east property line must be moved north approximately ten feet to increase the landscaped front yard adjacent to the spaces. The landscaped front yard in the southwest corner of the site must be increased so that it is approximately 30 feet at its widest point. Se e The proposed shade trees must be 3 1/2 inches in caliper and three more planted in the front yards in accordance with City Code Section 26-69(a)(1)(a). A thirty-inch evergreen hedge must be installed to screen the site's vehicular pavement from the right-of-Way in accordance with City Code Section 26-69(a) (1) (a). The existing pylon sign must be replaced with a sign which conforms to current sign regulations. Notwithstanding the above conditions, proposed redevelopment must be in general conformance with the Plan stamp dated April 6, 1993, which was submitted by the applicant.
