R-93-34 A RESOLUTION TO APPROVE THE REQUEST OF WILLS & VAN METRE, INC., BY ANN BOGAT, DIRECTOR, COMMERCIAL DIVISION, FOR SPECIAL EXCEPTIONS TO CITY CODE SECTIONS 26-44Co)(2)b4 AND 26-43(a)(6) TO ALLOW MORE THAN THE PERMITTED SQUARE FOOTAGE OF TENANT SIGNAGE ON THE PREMISES KNOWN AS 9900 MAIN STREET, AND MORE PARTICULARLY DESCRIBED AS TAX MAP PARCEL 58-3-((02))-013B. WHEREAS, Wills & Van Metre, Inc., by Ann Bogat, Director, Commercial Division, has submitted application No. SE-120-93-1 requesting a Special Exception to the City Code listed below: Section 26-43(a)(6) To allow a mansard sign to extend more than one foot (approximately 3 feet) from the mansard to which it is attached. Section 26-44Co)(2)b4 To allow an approximately 70 square-foot cumulative area for tenant signage where approximately 21 square feet is permitted; an individual tenant sign larger than the permitted 50 square feet (approximately 60 square fee0; and, to allow a tenant sign to be allowed on a building at the fifth floor level where the maximum height permitted is 3.5 feet above the finished floor level of the second story. WHEREAS, City Council has determined that the following Special Exceptions Section 26-43(a)(6~ To allow a mansard sign for Intertek/Inchcape to extend more than one foot (approximately 3 feet) from the mansard to which it is attached. Section 26-44~)(2)b4 To allow an approximately 70 square-foot cumulative area for tenant signage where approximately 21 square feet is permitted; and, to allow a tenant sign to be allowed on a building at the fifth floor level where the maximum height permitted is 3.5 feet above the finished floor level of the second story. are appropriate because they meet the requisites established by City of Fairfax Code Section 26-48 for the following reasons: The signage requirements will present a unique burden due to unusual building design/lot shape; and Be The granting of thc special exceptions will not be inconsistent with the comprehensive plan or the purpose of the sign regulations; and WHEREAS, City Council further has determined that the following Special Exception Section 26-44~)(2)b4 An individual tenant sign larger than the permitted 50 square feet (approximately 60 square feet) is not appropriate because it does not meet the requisites established by City of Fairfax Code Section 26-48 for the following reasons: Insufficient justification has been given to permit signage for an individual tenant in excess of the 50 square-foot maximum prescribed by the Code. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fairfax on this 27th day of July, 1993, that application No. SE-120-93-1 be and hereby is APPROVED in part with the following conditions: 1. The Van Metre tenant sign shall be removed from the building; and The new tenant signage shall not exceed fifty (50) square feet in area and shall be located so that the top of the new tenant sign for Inchcape shall be at least one foot from the top of the mansard. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fairfax on this 27th day of July, 1993, that application No. SE-120-93-1 be and hereby is APPROVED. ATTEST: City Clerk
