19931214 r-93-48RF_$OLUTION NO. R-93- 48 RESOLUTION TO APPROVE THE REQUEST OF T.R. BARKER, PROPERTY OWNER, BY DAVID S. HOUSTON, ATI'ORNEY, FOR SPECIAL EXCEPTIONS TO CHAPTER 26 OF THE CITY CODE ON THE PREMISES KNOWN AS 3171 SPRING STREET, AND MORE PARTICULARLY DESCRIBED AS TAX MAP PARCEL 48-3-((9))-41 AND 42. WHEREAS, T.R. Barker, property owner, by David S. Houston, Attorney, has submitted application No. SE-125-93-1 requesting Special Exceptions to the City Code listed below: Section 26-39.4Co)(4)(b) To reduce the amount of parking spaces required for industrial uses by as much as 30 %; and Section 26-39.2(e) and 26-69(a)(1)(a) To reduce or eliminate the required 25-foot landscaped front yard. WHEREAS, City Council has determined that the proposed Special Exceptions as modified by the conditions listed below are appropriate because the proposal meets the requisites established by City of Fairfax Code Sections 26-39.7 and 26-103(c) for the following reasons: The site cannot accommodate both the parking spaces required to allow occupancy of the building and the required landscaped front yard. A limited reduction of the amount of required parking will not be detrimental to adjacent streets and private property provided all employee and customer vehicles are accommodated on-site. Granting the Special Exceptions is consistent with the goals of the Comprehensive Plan to encourage the economic vitality of the City. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fairfax on this 14th day of December, 1993, that application No. SE-125-93-1 be and hereby is APPROVED with the following conditions: Tenants of the building must be uses that do not generate more customer traffic than can be accommodated on-site. Prior to approval of a Certificate of Occupancy, prospective tenants must submit to the Zoning Office documentation that employee and customer vehicles will not exceed the number of parking spaces available on-site. The total number of required parking spaces may not exceed the number of parking spaces provided by more than 15 %. ATTEST:
