R-92-3 A RESOLUTION TO APPROVE THE REQUEST OF GEORGE KIRKLAND, D/B/A, MASTER TRANSMISSION SERVICE FOR SPECIAL EXCEPTIONS TO THE CITY CODE, CHAPTER 26, ARTICLE II, DIVISION 6, SECTION 26-44(b) (2) (c)3i TO PERMIT MORE THAN THE ALLOWED SQUARE FOOTAGE OF TENANT SIGNAGE; AND26-39.4 (b)(3)(b) TO PERMIT REDUCTION OF THE NUMBER OF ON-SITE PARKING SPACES; ON THE PREMISES KNOWN AS 3171-A SPRING STREET WHEREAS, George Kirkland, d/b/a Master Transmission Service Center, has submitted application No. SE-88-92-2 requesting Special Exceptions to the City Code listed below: Section 26-44(b) (2)(c)3i to permit more than the allowed square footage of tenant signage. Section 26-39.4(b) (3) (b) to permit reduction of the number of on-site parking spaces; WHEREAS, City Council has determined that the proposed Special Exception is appropriate because the proposal meets the requisites established by City of Fairfax Code Sections 26-39.7(c), 26-48(b), and 26-103(c) for the following reasons: The proposal will permit the reasonable use of the subject property; 2. The proposal will not result in negative impacts to the community; and The proposal is consistent with the objectives of the Comprehensive Plan for future industrial land uses and is not inconsistent with the Comprehensive Plan or purpose of the City sign regulations to provide adequate, well-designed signage. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fairfax on this llth day of February, 1992, that application No. SE-$8-92-2 be and hereby is APPROVED, subject to the following conditions: The applicant's lease for the off-site vehicle storage area must be for at least seven parking spaces and be approved by the City Attorney; such approval must be obtained prior to appearing before the Board of Zoning Appeals for the required Special Use Permit; The lease for the seven required off-site parking spaces and all renewals thereto must be recorded in Fairfax County Land Records and a copy submitted to the City Zoning Office; A loss of or the failure to renew the City approved lease for the seven required off-site parking spaces will invalidate the Special Exception to Section 26-39.4(b) (3) (b); An appointment system must be established and adhered to in order to limit the number of vehicles stored by the business on-site; The three exterior parking spaces must be marked "Reserved for Customers of Master Transmission Service"; R-92-3 ® e No additional dumpster facility may be located outside the building; Additional landscape materials must be installed on-site in coordination with the property owner and the City staff.
