RESOLUTION TO APPROVE THE REQUEST OF CHEVRON U.S.A.,
INC., BY C.M. ALLEN, CONSTRUCTION AND MAINTENANCE
REPRESENTATIVE, FOR SPECIAL EXCEPTIONS TO THE CODE OF
THE CITY OF FAIRFAX, VIRGINIA FOR EXCEPTIONS TO THE SIGN
ORDINANCE FOR PROPERTY LOCATED AT 11098 MAIN STREET.
WHEREAS, Chevron U.S.A., Inc., by C.M. Allen, Construction
and Maintenance representative, has submitted application No.
SE-87-92-2 requesting special exceptions to the City Code as
listed below:
Section 26-44(a) Table Il - To allow more ground-mounted
sign area than the permitted 32.5 square feet;
Sections 26-43(a)(3) and 26-44(a) Table II - To allow a
ground-mounted sign to be closer than the required 20 feet
from the public right-of-way; and
Section 26-44(a) Table II - To allow a ground-mounted sign
to be taller than the permitted six-foot height,
on the premises known as 11098 Main Street and more particularly
described as tax map 57-1-((2))-039C.
WHEREAS, City Council has determined that the proposed
special exceptions are appropriate because they meet the
requisites established by City of Fairfax Code Sections
26-48(b) (1) and (2) and 26-103(c) (1-11) for the following
reasons:
The applicant has demonstrated that compliance with
City Code sign regulations will present a unique
burden due to site design; and
The granting of this special exception will not be
inconsistent with the Comprehensive Plan or the
purpose of the sign regulations as stated in Section
26-40;

This special exception as modified by the below-stated
conditions meets the criteria of Section 26-103(c).
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Fairfax on this 25th day of February, 1992, that the
special exceptions described above and in application No.
SE-87-92-2 be and hereby is approved with the following con-

The minimum sign setback to be seven feet;
The maximum height of the sign be no more than 8.25 feet;
The maximum sign area be no more than 40 square feet;
The area around the sign be landscaped in coordination with
the staff;
The dumpster enclosure required by the Board of Archi-
tectural Review be installed prior to the proposed sign's
installation, as well as recycling procedures;
The dead plant materials on site be replaced at the time
of the installation of the sign landscaping;
Constant monitoring by the management of automobiles parked
on the property that may be inoperative, abandoned, etc.,
to be removed from the premises.
