RESOLUTION APPROVING THE REQUEST OF THE CITY OF FAIRFAX
SCHOOL BOARD FOR SPECIAL EXCEPTIONS TO CHAPTER 26
OF THE CODE OF THE CITY OF FAIRFAX, VIRGINIA,
TO PERMIT INSTALLATION OF A FREE-STANDING SIGN AT
FAIRFAX HIGH SCHOOL, 3500 OLD LEE HIGHWAY.
WHEREAS, the Fairfax City School Board, by Robert C.
Russell, Superintendent, has submitted application No. SE-90-2-1
requesting a special exception to the City Code listed below:
Section 26-44(a) and Table 1 - To allow a sign style other
than the permitted ground mounted;
Section 26-43(a)(3) and (8) and 26-44(a) and Table 1 - To
allow a free-standing sign to be closer than the required
20 feet from the public right-of-way;
Section 26-43(a)(8) - To allow a free-standing sign to be
closer than the required 20 feet from the front and side
property lines;
Section 26-44(a) and Table 1 - To allow a sign to be taller
than the permitted six feet; and
Section 26-44(a) and Table 1 - To allow more than the
permitted 24 square feet of sign area.
WHEREAS, City Council has determined that the proposed
special exceptions numbered 1, 2, 3 and 5 are appropriate
because the requests meet the requisites established by City of
Fairfax Code Sections 26-48(b)(1) and (2) and 26-103(c)(1-11)
for the following reasons:

The applicant has demonstrated that compliance with
City Code sign regulations will present a unique
burden due to the size and shape of the property and
existing topographic conditions; and
The granting of these special exceptions will not be
inconsistent with the Comprehensive Plan or the
purpose of the sign regulations as stated in Section
26-40.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Fairfax on this 24th day of March, 1992, that special
exceptions numbered 1, 2, 3 and 5 in application No. SE-90-92-1
be and hereby is approved, with the following conditions:
1. The maximum sign height be no greater than six feet;
2. Low maintenance dwarf shrubs or other vegetation be
installed across the base of the sign.
BE IT FURTHER RESOLVED by the City Council of the City of
Fairfax on this 24th day of March, 1992, that special exception
numbered 4 above and in application No. SE-90-92-1, is not
appropriate because it does not meet the requisites established
in Section 26-48 of the City Code and is denied for the
following reasons:

The applicant has not demonstrated that compliance
with the City Code sign height restrictions will
present a unique burden; and
The proposed sign can be modified to meet the allowed
six-foot height without affecting the signs' visibi-
lity or the proposed design.
