R-92-23 RESOLUTION TO APPROVE THE REQUEST OF VARMA ENTERPRISES, INC., BY RAVINDER VARMA, PRESIDENT, FOR A SPECIAL EXCEPTION TO THE CODE OF THE CITY OF FAIRFAX, VIRGINIA, FOR SERVICE STATION IMPROVEMENTS FOR PROPERTY LOCATED AT 9555 ARLINGTON BOULEVARD WHEREAS, Varma Enterprises, Inc., by Ravinder Varma, President, has submitted application No. SE-95-92-1 requesting a special exception to the City Code listed below' Section 26-173(c)(1) To allow installation of service station improvements (canopy, flagpoles) without the provision of the required 25-foot front setback. WHEREAS, City Council has carefully considered the application, the recommendation of the staff and testimony received at the public hearing; and WHEREAS, Clty Council has determined that the proposed Special Exception ~s appropriate because the proposal as modified by the conditions of approval meet the requisites established by City of Fairfax Code Sections 26-103 and 26-173(0 for the following reasons' The proposal will not result in a development disproportionate to surrounding land uses in size, bulk, or scale; The proposal will not adversely affect existing traffic patterns, any nearby areas, or otherwise negatively impact the community; o The proposal is consistent with the objective of the Comprehensive Plan to improve the appearance of major commercial corridors. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fairfax on this 9th day of June, 1992, that application No. SE-95-92-1 be and hereby is APPROVED with the following conditions: The design and location of the two flagpoles must be approved by the Director of Public Works. The final landscape design must be coordinated with the staff to adequately address safety and screening. o The existing dumpster must be screened per City Code Section 26-68(b) and recycling facilities provided as deemed necessary by the Public Works Director. The design of all architectural and landscape features included in this application must be reviewed and approved by the Board of Architectural Review prior to installation. R-92-23 -2 In the event of road construction, which requires the City's utilization of the public right-of-way used by the applicant, all landscape materials and the flagpoles must be relocated at the applicant's expense.
