R-92-39 RESOLUTION TO APPROVE THE REQUEST OF FAIRFAX VOLUNTEER FIRE DEPARTMENT, BY JOHN OBREMSKI, MEMBER OF THE BOARD, FOR SPECIAL EXCEPTIONS TO THE CODE OF THE CITY OF FAIRFAX, VIRGINIA, FOR PROPERTY LOCATED AT 4081 UNIVERSITY DRIVE, TAX MAP PARCEL 57-4-((2))-42A. WHEREAS, Fairfax Volunteer Fire Department, by John Obremski, Member of the Board, has submitted application No. SE-96-92-1 requesting a Special Exception to the City Code listed below: Section 26-43(a)(3) and (8) - To allow ground-mounted signage to be located less than the required 20 feet from the public right-of-way and front lot line; and Section 26-44(a) Table I - To allow more than the permitted 24 square feet of signage. WHEREAS, City Council has determined that the proposed Special Exception is appropriate because the proposal meets the requisites established by City of Fairfax Code Sections 26-48 and 26-103 for the following reasons' 1. The subject property has a unique burden due to the site design and distance from the University Drive travelway. Approval of tile requested Special Exceptions will not create negative impacts to adjacent properties or existing traffic patterns. o Granting the Special Exceptions are not inconsistent with the goals of the Comprehensive Plan or the purpose of the Sign Ordinance. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fairfax on this 14th clay of July, 1992, that application No. SE-96-92-I be and hereby is APPROVED with tile condition that no temporary signs be displayed on the premises of 4081 University Drive.
