R-92-40 RESOLUTION TO AMEND CITY CODE CHAPTER 26, ARTICLE XII, (C-l, OFFICE CO1V[MERCIAL DISTRICT), SECTION 26-167 (SAME -- WITH SPECIAL USE PERMIT) AND ARTICLE XIII, (C-2, RETAIL COMMERCIAL DISTRICT), SECTION 26-172, (SAME -- WITH SPECIAL USE PERMIT), TO PERMIT RESIDENTIAL USES IN THE C-1 AND C-2 DISTRICTS. WHEREAS, residential uses are currently not permitted in the C-1 and C-2 zoning districts outside Old Town Fairfax; and WHEREAS, residential uses, under certain conditions, may enhance the commercial districts by providing a means of utilizing vacant space and providing on-site security; and WHEREAS, residential uses may stimulate economic development by allowing residential tenants to fill appropriately situated vacant commercial space and provide a source of tax revenues for the City; and WHEREAS, residential uses may be individually reviewed through the Special Use Permit public hearing to ensure that they satisfy pertinent City regulations; NOW, THEREFORE, BE IT RESOLVED THAT the City Council of the City of Fairfax, Virginia, refer to the Planning Commission for study, public hearing, and recommendation a proposed text amendment to City Code Chapter 26, Article XII, (C-1, Office Commercial District), Section 26-167 (same -- with Special Use Permit) and Article XIII, (C-2 Retail Commercial District), Section 26-172, (same -- with Special Use Permit), to permit residential uses in the C-1 and C-2 districts.
