19921110 r-92-53RESOLUTION NO. R-92-63 RESOLUTION TO APPROVE THE REQUEST OF NATIONSBANK, NA, BY TONI L. MCMAHON, AGENT, FOR SPECIAL EXCEPTIONS TO THE CODE OF THE CITY OF FAIRFAX, VIRGINIA, FOR PROPERTY LOCATED AT 11190 MAIN STREET, TAX MAP PARCEL 57-1-((2))-5. WHEREAS, NationsBank of Virginia, NA, by Toni L. McMahon, Agent has submitted application No. SE-101-92-1 requesting Special Exceptions to the City Code listed below: Section 26-44(a). Table II To allow a free-standing sign style other than the allowed ground-mounted; To allow a free-standing sign to be taller than the allowed six feet; Section 26-43-(a)(3) and (8) and Table II To allow a free-standing sign to be located closer to the right-of-way and front property line than the required twenty feet WHEREAS, City Council has determined that the proposed Special Exceptions are appropriate because the proposal meets the requisites established by City of Fairfax Code Section 26-48 and 26-103 for the following reasons: The applicant has clearly demonstrated that the existing site design and topography present a unique burden; and The granting of the Special Exceptions are consistent with the goal of the Comprehensive Plan and purpose of the Sign Ordinance. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Falrfax on this 10th day of November, 1992, that application No. SE-101-92-1 be and hereby is APPROVED with the following conditions: 2. 3. 4. Total sign height be no more than nine feet; The sign face area be no more than 35 square feet; The sign setback be no less than 15 feet; The sign base be a landscape planter constructed of brick to match the bank building; and Two 3.5-inch caliper deciduous trees be planted in the landscape strip along Jermantown Road. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fairfax on this 10th day of November, 1992, that application No. SE-101-92-1 be and hereby is APPROVED.
