R-91-9 A RESOLUTION TO APPROVE THE REQUEST OF SHELL OIL COMPANY, BY DON DEMUMBRUM, MID-ATLANTIC DISTRICT MANAGER, FOR TWO SPECIAL EXCEPTIONS TO THE ZONING ORDINANCE ON THE PREMISES KNOWN AS JERMANTOWN SHELL SERVICE STATION LOCATED AT 11201 MAIN STREET, AND MORE PARTICULARLY DESCRIBED AS TAX MAP 57-1-((2))-4A. WHEREAS, Shell Oil Company, by Don Demumbrum, Mid-Atlantic District Manager, has submitted application No. SE-79-90-1 requesting two Special Exceptions to the city Code listed below: Section 26-69(a)(1)(a): To allow a front landscaped strip to be eight feet less in width than the required twenty- five feet; Section 26-178(c)(1): To allow a front yard to be eight feet less in width than the required twenty-five feet. WHEREAS, City Council has determined that the proposed Special Exceptions are appropriate because the proposed development meets the requisites established by City of Fairfax Code Section 26-71.2, 26-173(f)(1 and 2) and 26-103(c) (1-11) for the following reasons: The applicant has clearly demonstrated that the requests will not result in any negative impact to the surrounding area or to the City as outlined in Section 26-173(f)(2); The City Council has determined that the granting of the request for Special Exceptions, as modified by the conditions of approval, will not be inconsistent with the Comprehensive Plan, the Community Appearance Plan, and the purpose of Division 10 "Tree Preservation, Landscaping, and Screening" as stated in Section 26-61; The criteria of Section 26-103(c) have been considered and the request, as modified by the conditions of approval, is consistent with those criteria. NOW, THEREFORE, BE IT RESOLVED by the City Council of the city of Fairfax on this 26th day of February, 1991, that application No. SE-79-90-1 be and hereby is approved subject to the following conditions: The proposed landscaping along the Main Street frontage be modified per the Community Appearance Plan to include additional red maple trees; The proposed tree caliper be increased to three and one- half inches per Section 26-69 (a) (1) (a); The proposed screening hedge in the landscaped island on the northeast corner of the site be extended the full width of the island per Section 26-69(a)(1)(a); Sidewalk handicap ramps be installed for the reconstructed Main Street driveways per Section 26-14; R-9i-9 -2- 0 The property owner and/or station manager police the property on a daily basis for the removal of trash and other debris; o The drive aisle behind the building be posted and marked as a "no parking" area.
