19910312 r-91-11RESOLUTION NO. R-91-11 RESOLUTION TO APPROVE THE REQUEST OF NATIONAL CAPITAL PRESBYTERY, INC., OWNER, AND FAIRFAXPRESBYTERIANCHURCH, CONGREGATIONAL USER, BY JAMES P. LITTEN, ATTORNEY-IN- FACT, NATIONAL CAPITAL PRESBYTERY, INC., AND TRUSTEE, FAIRFAX PRESBYTERIAN CHURCH FOR A SPECIAL EXCEPTION TO SECTION 26-39.1(h)(3) ON THE PREMISES KNOWN AS FAIRFAX PRESBYTERIAN CHURCH, 10723 MAIN STREET, AND MORE PARTICULARLY DESCRIBED AS TAXMAP 57-1((2))-123 AND 122A. WHEREAS, National Capital Presbytery, Inc., Owner, and Fairfax Presbyterian Church, Congregational User, by James P. Litten, attorney-in-fact, National Capital Presbytery, Inc., and Trustee, Fairfax Presbyterian Church has submitted application No. SE-80- 91-1 requesting a Special Exception to the City Code listed below: Section 26-39.1(h)(3) to permit an aggregate increase in gross floor area of more than 30 percent without the required improvements to the existing non-conforming parking area. WHEREAS, City Council has determined that the proposed Special Exception is appropriate because the proposed development meets the requisites established by City of Fairfax Code Section 26-39.7(c) for the following reasons: The request will not result in increased traffic congestion or otherwise negatively impact existing traffic flow or pedestrian and vehicular safety as the parking area will remain as it exists, with no increase in use; The request, as modified by the conditions of the Special Use Permit (SU-1259-91-1) approval, will not be contrary to the objective specified in the Comprehensive Plan; The request will permit the reasonable use of the subject property; The request, as modified by the conditions of the special use permit (SU-1259-91-1) approval, will not adversely impact adjacent property or the surrounding area; The request, as modified by the conditions of the special use permit (SU-1259-91-1) approval, does not adversely affect the criteria of Section 26-103(c). NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fairfax on this 12th day of March, 1991, that application No. SE-$0-91-1 be and hereby is APPROVED.
