A RESOLUTION EXTENDING THE CLOSING DATE OF
THE SALE TO CHERYL D. COLBERT OF SURPLUS CITY
REAL ESTATE AND IMPROVEMENTS AT 4226 UNIVERSITY DRIVE
WHEREAS, on May 14, 1991, by Ordinance No. 1991-11, the City
Council of the City of Fairfax, Virginia, declared the real estate
and improvements at 4226 University Drive to be surplus City
property, accepted the offer of Cheryl D. Colbert dated April 10,
1991, to purchase the real estate (the "Offer"), authorized the
real estate to be sold to Ms. Colbert, and authorized a deed to be
executed by the City Manager on behalf of the City; and
WHEREAS, Paragraph 7 of the Offer obligated Ms. Colbert to
close within 60 days after May 14, 1991 (i.e., by July 13, 1991)
which date was extended by the City Council at her request to
September 10, 1991; and
WHEREAS, in order to facilitate the release of liens upon the
title to the property more time is needed and sixty (60) days is
sufficient to accomplish these tasks.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Fairfax, Virginia, that the City hereby amends Paragraph 7 of
the Offer from Cheryl D. Colbert to the City of Fairfax to provide
that settlement shall occur no later than November 12, 1991.
BE IT FURTHER RESOLVED that all other provisions in the Offer
and acceptance thereof by the City shall remain in full force and
effect.
