R-91-36 RESOLUTION TO DENY THE REQUEST FOR SPECIAL EXCEPTIONS TO THE CITY CODE OF THE CITY OF FAIRFAX, VIRGINIA, FOR HANA ORIENTAL MARKET, INC., BY SYNG MAN RHEE, PRESIDENT, FOR THE PREMISES KNOWN AS LOTTE PLAZA, 3250 OLD LEE HIGHWAY WHEREAS, Hana Oriental Market, Inc., by Syng Man Rhee, President, has submitted application no. SE-83-91-1 requesting special exceptions to the City Code listed below: Section 26-39.1(h)¢2) To permit a change in use which increases the parking space requirement by more than 30 percent without the required site improvements pursuant to Section 26-39-7(c). Section 26-39.7(a) To permit a 20 percent reduction in the total number of required parking spaces (38 spaces) as allowed in shopping center and mixed use developments. Section 26-39.7(b) To permit off-site provision of required parking spaces (45 spaces at the Ground Round) where practical difficulties unreasonably restrict the provision of on-site parking spaces. Section 26-43(a)(1) To permit display of off-site signage pursuant to Section 26-48. Section 26-47(d)(4) To permit a non-conforming sign advertising a discontinued use, to be reused and not removed pursuant to Section 26-48. WHEREAS, City Council has carefully considered the application, the recommendation of the staff and testimony received at the public hearing; and WHEREAS, City Council has determined that the proposed special exceptions are not appropriate because the proposal does not meet the requisites established by City of Fairfax Code Sections 26-39.7, 26-48(b) and Section 26-103(c) for the following reasons: 1. Trip generation characteristics of the proposed use. Concern about the safety and movement of vehicular traffic upon adjacent streets. Overall impact of the proposed use upon the development and use of adjacent land. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fairfax on this 15th day of October, 1991, that application no. SE-83-91-1 be and hereby is denied.
