WHEREAS, by Resolution R-89-33 adopted on August 29,
1989, the City Council determined that additional public
parking is needed in the downtown area, that tax map
parcel 57-4-((2))-120 (the "parcel") is suitable for such
public purpose and that a public necessity exists for the
acquisition of the parcel; and
WHEREAS, by such resolution, the City Council
authorized and directed the initiation and pursuit of
condemnation proceedings to acquire the parcel for public
purposes according to State law; and
WHEREAS, the City Council has determined that, although
additional public parking is needed in the downtown area
and although the parcel is suitable for such public
purpose, acquisition of such parcel by condemnation should
be terminated; and
NOW, THEREFORE, BE IT RESOLVED, that condemnation
proceedings to acquire tax map parcel 57-4-((2))-120 for
public purposes shall be terminated; and
BE IT FURTHER RESOLVED, that the City Council directs
the City Manager is hereby directed to forward immediately
an attested copy of this resolution to the property owner
or owners of such parcel.
