R-90-7 A RESOLUTION TO APPROVE THE REQUEST OF FAIRFAX RACQUET CLUB, INC., BY GREG SARGENT, AGENT, SERVICE NEON SIGNS, INC., FOR SPECIAL EXCEPTIONS TO THE SIGN ORDINANCE ON THE PREMISES KNOWN AS FAIRFAX RACQUET CLUB, INC., LOCATED AT 9860 LEE HIGHWAY AND MORE PARTICULARLY DESCRIBED AS TAX MAP 48-3-((2))-2 WHEREAS, Fairfax Racquet Club, Inc., has submitted application No. SE-66-90-1 requesting special exceptions to the City Code as follows: Section 26-43(a) (1): located on property principal use. To allow a free-standing sign to be that is not the same lot as the Section 26-43(a) (3) and Table II: To allow a free-standing sign with a height of 20 feet where a 6-foot limit is allowed. Section 26-43(a) (7): To allow a free-standing sign on a property that does not have at least 100 feet of road frontage. Section 26-43(a)(8): To allow a free-standing sign to be located less than 20 feet from the side property line. Section 26-46(m): To permit a pylon sign where such signs are prohibited. WHEREAS, City Council has determined that the proposed special exceptions are appropriate because the proposed sign meets the requisites established by Fairfax City Code Section 26-48 for the following reasons: The applicant has clearly demonstrated that require- ments contained in this division will present a unique burden due to unusual topography, vegetation, building design or lot shape; and The City Council has determined that the granting of special exceptions will not be inconsistent with the Comprehensive Plan or the purpose of this division as stated in Section 26-40. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fairfax, Virginia on this 27th day of Februar~ , 1990, that application No. SE-66-90-1 be and hereby is approved subject to the following conditions: Tree plantings in accordance with the Community Appearance Plan for Lee Highway should be added on the east side of the driveway (adjacent to Auto Buying Service.) So Lower story evergreen shrubbery on the east side of the drive should be added. The west side of the drive area should be weeded and policed for trash, and evergreen shrubs should be planted to supplement existing vegetation and screen the Kenny Roberts Nursery building and fencing. The roadway surface should be patched and repaved as necessary and the east side shoulder area improved. The applicant should maintain the entire 50-foot wide entrance area (i.e., mowing, trimming, watering, fertiliz- ing, trash pickup and the like). R-90-7 -2 -2- o Evergreen shrubs, such as American Arborvitae, should be planted alongside the dumpster fence to supplement the screening of the dumpster area. The sign located should be 30 feet off of the existing Lee Highway right-of-way to accommodate the proposed 10-foot widening of Lee Highway, or may be located at its current location and then must be relocated upon the widening of Lee Highway to satisfy City setback requirements.
