R-90-Sa A RESOLUTION TO APPROVE THE REQUEST OF THE 50-JERMANTOWN LIMITED PARTNERSHIP, OWNER, FOR SPECIAL EXCEPTION FROM SPECIFIED PROVISIONS OF CHAPTER 26 OF THE CODE OF THE CITY OF FAIRFAX FOR PROPERTY LOCATED AT 11130, 11150, and ll166MAIN STREET AND MORE PARTICULARLY DESCRIBED AS TAX MAP 57-1-((2))-6 AND 38. WHEREAS, 50-Jermantown Limited Partnership has Submitted application No. SE-52-89-1 requesting the Special Exception to the City Code listed below: Section 26-39.4(a)(5): To permit a parking stall width of 8 feet (9 feet required) for 189 parking spaces. WHEREAS, City Council has determined that the proposed Special Exception is appropriate because the proposed development meets the requisites established by Fairfax city Code Section 26-39.7(c) for the following reasons: Section 26-39.7(c): Will not result in increased traffic condition or otherwise negatively impact existing traffic flow or pedestrian or vehicular safety; Will not be contrary to the objective specified in the Comprehensive Plan; Will permit the reasonable use of the subject property; and Will not adversely impact adjacent property or the surrounding area. NOW, THEREFORE, BE IT RESOLVED by the city Council of the City of Fairfax on this 27th day of February, 1990, that application No. SE-52-89-1 be and hereby is APPROVED, subject to the following conditions: The Management of the Office Plaza institute and monitor a system of reserving these spaces for compact vehicles. For vehicles to be considered compacts, the must be 5- 1/2 feet or less in width. No assignment of specific parking spaces to individuals is to be made. The compact car spaces are to be utilized on a first-come first- served basis. The Management of the office Plaza notify all tenants of the buildings that their use of Bevan Drive as parking area is prohibited and provide a monitoring system to assure that this condition is met. The city will not be held liable by either the Property Management/Owners or any tenants for any damages or injuries resulting over this reduction in the width on the parking spaces. The management firm, 50-Jermantown Limited Partnership, assign a Transportation Management Coordinator and report the name and phone number of that individual to the Zoning office. The Transportation Management Coordinator and the management firm continue to actively promote ridesharing and public transit use as outlined in the Transportation Management Plan. '~90-8A -2 e The Transportation Management Coordinator maintain records of participants in the ridesharing and transit usage programs. These records must be available for inspection by the Zoning Office staff when requested and summarized as part of the applicant's report to Council at the end of the year's approval period.
