19900327 r-90-09RESOLUTION NO. R-90-9 A RESOLUTION TO APPROVE THE REQUEST OF BURDETTE & FRITZ, LTD., LESSEE, BY THOMAS E. BURDETTE AND WILLIAM A. FRITZ, SHAREHOLDERS, FOR A SPECIAL EXCEPTION TO THE SIGN ORDINANCE ON THE PREMISES KNOWN AS THE FOSTER BUILDING, LOCATED AT 3975 UNIVERSITY DRIVE AND MORE PARTICULARLY DESCRIBED AS TAX MAP 57-2-((20))-2. WHEREAS, Burdette & Fritz, Ltd., has submitted application No. SE-70-90-1 requesting a Special Exception to the city Code as follows: Section 26-44(b) (2)c3: To allow a building-mounted sign for a tenant on a multi-tenant office building where such sign is prohibited. WHEREAS, City Council has determined that the proposed Special Exception is appropriate because the proposed sign meets the requisites established by Fairfax city Code Section 26-48 for the following reasons: The building landlord has agreed to waive his right for a building-mounted identification sign for a period not to exceed five years. The applicant has agreed to remove the sign at any time during the five-year period if the landlord decides to install the building-mounted identification sign. NOW, THEREFORE, BE IT RESOLVED by the City Council of the city of Fairfax on this 27th day of March, 1990, that application No. SE-70-90-1 be and hereby is APPROVED subject to the condition that Burdette and Fritz may use the building identification sign per the lease agreement with Foster Brothers for a period not to exceed five years. If extension of the five-year period is desired and agreeable to the landlord, tenant and the City, a new application shall be submitted. ADOPTED this 27th day of March , 1990. ATTEST: Clerk
